Florida rules investors should know

  • Foreclosure process: judicial (the lender files a lawsuit and a court orders the sale). Judicial foreclosure usually takes longer, which some lenders reflect in leverage or pricing.
  • Security instrument: loans are usually secured by a mortgage, recorded with the county where the property sits.
  • Licensing: rules for business-purpose lending vary; lenders on our network confirm they hold every license their loans require. State agencies are listed by the Conference of State Bank Supervisors.
  • Statutes: Florida Code (via Justia).

How fix and flip loans are sized

Lenders set three limits and lend the lowest: a percentage of the purchase price plus the rehab budget (purchase LTC), a percentage of the total project cost (LTC), and a percentage of the after-repair value (loan-to-ARV). Experienced investors with strong credit typically qualify for higher limits. The ARV and max loan calculator shows which limit decides your loan.

What to compare

You pay an interest rate, origination points (each point is 1% of the loan), lender fees, and sometimes exit points or a minimum-interest period. Some lenders charge Dutch interest on the full loan from day one; others charge only on funds drawn. Comparing total cost over your hold period, not just the rate, is the only fair comparison.
